Terms of Service & Disclaimer

By using SafeFile Solution's services — whether booking online, by phone, email, social media, or in person — you ("the Customer") agree to the following terms and conditions. Please read them carefully before submitting any device or storage media for service.
1. Lawful Use Only
All services provided by SafeFile Solution are intended for lawful purposes only. By requesting any service, the Customer confirms and warrants that:
- They are the legal owner of the device or storage media submitted, or have written authorisation from the legal owner to request the service.
- The device or data is not subject to any ongoing or pending legal investigation, litigation, court order, regulatory enquiry, or law enforcement hold that would require the preservation of data.
- The request is not being made to conceal, destroy, or tamper with evidence related to any criminal or civil matter.
- The data being wiped, recovered, or Handled does not belong to a third party without that party's explicit consent.
Important: SafeFile Solution reserves the right to refuse any service if there is reasonable suspicion that the request is connected to illegal activity, evidence destruction, or any attempt to circumvent legal obligations. We may report suspected illegal activity to the appropriate authorities as required by UK law.
2. Ownership & Authorisation
The Customer represents and warrants that they have full legal authority to request services on the device(s) or storage media submitted. This includes:
- Personal devices owned outright by the Customer.
- Business devices where the Customer has written authority from the business owner or a director to authorise data destruction or recovery.
- Devices belonging to a deceased person where the Customer is the executor of the estate or has legal authority to manage the deceased's digital assets.
SafeFile Solution accepts no liability if a Customer submits a device they do not own or do not have authority over. The Customer indemnifies SafeFile Solution against any claims arising from unauthorised submissions.
3. Data Destruction — Irreversibility
The Customer understands and acknowledges that:
- Secure data wiping is permanent and irreversible. Once a drive or device has been wiped using our methods, the data cannot be recovered by any means.
- SafeFile Solution will issue a Certificate of Destruction upon completion, documenting the device serial number, wiping method used, and date of service.
- It is the Customer's sole responsibility to back up any data they wish to keep before submitting a device for wiping.
- SafeFile Solution accepts no liability for data loss resulting from a service the Customer has requested and authorised.
Please ensure you have backed up anything you need before submitting your device for wiping. This cannot be undone.
4. Data Recovery — No Guarantee
Data recovery is attempted on a best-effort basis using professional tools and methods. The Customer acknowledges that:
- Recovery success depends on the type and extent of damage, and cannot be guaranteed.
- SafeFile Solution will provide an honest assessment before proceeding and will not charge for recovery if no data is recovered (unless a diagnostic fee has been agreed in advance).
- Recovered data is provided as-is. SafeFile Solution is not responsible for the integrity, completeness, or usability of recovered files.
5. Device Handling & Liability
SafeFile Solution takes reasonable care when handling customer devices and storage media. However:
- Devices submitted for repair or service may carry pre-existing faults, damage, or wear that could affect the outcome.
- SafeFile Solution is not liable for devices damaged during postal transit. Customers using the postal service do so at their own risk and are advised to use tracked, insured delivery.
- Maximum liability for any claim shall not exceed the fee paid for the service in question.
6. Right to Refuse Service
SafeFile Solution reserves the absolute right to refuse or terminate any service request at any time, without obligation to provide a reason, including but not limited to situations where:
- There is reasonable suspicion of unlawful intent or activity.
- The Customer cannot provide satisfactory proof of ownership or authorisation.
- The Customer is abusive, threatening, or uncooperative.
- The device appears to contain illegal material (which will be reported to the authorities).
7. GDPR & Data Protection Compliance
SafeFile Solution operates in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We:
- Do not access, read, copy, or store any customer data during the wiping process.
- Process customer contact information (name, email, phone) only for the purpose of delivering the requested service.
- Do not share customer information with third parties except as required by law.
- Retain service records (device serial numbers, certificates of destruction) for a period of 3 years for our records and your protection.
8. Postal Service Terms
For customers using our postal/mail-in service:
- Devices are posted at the Customer's own risk. SafeFile Solution is not responsible for items lost, stolen, or damaged in transit.
- Customers are strongly advised to use Royal Mail Tracked or a courier service with insurance.
- SafeFile Solution will return devices via Royal Mail Tracked unless an alternative is agreed.
- Devices uncollected or unreturnable after 30 days of service completion may be securely destroyed.
9. Payment
Payment terms will be agreed before service begins. No work is carried out until the Customer has confirmed the service and agreed to the quoted price. Payment is due upon completion of the service unless otherwise agreed.
10. Limitation of Liability
To the fullest extent permitted by law, SafeFile Solution shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our services. The Customer agrees to indemnify and hold SafeFile Solution harmless against any claims, losses, or damages arising from:
- Misrepresentation of ownership or authority.
- Submission of devices involved in legal proceedings without disclosure.
- Any unlawful use of SafeFile Solution's services.
11. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to These Terms
SafeFile Solution may update these terms from time to time. The most current version will always be available on this page. Continued use of our services after changes constitutes acceptance of the updated terms.
